GENERAL CHARACTERISTICS OF THE CONCEPT OF CRIME AND ITS SIGNS
Abstract
The law defines a crime as a socially dangerous act or omission. It is based on a material symbol - the social threat of the act. Criminological social danger is the condition of the objective aspect of the crime. It relates the elements and symptoms of the crime, which includes the possibility of actual harm to the social relations protected by the law. Public danger is an objective symptom of this crime, and its presence or absence does not depend on the discretion of the law enforcement agencies of the legislature.

Аннотация
Закон определяет преступление как общественно опасное действие или бездействие. В его основе лежит материальный символ - социальная угроза деяния. Криминологическая общественная опасность -это состояние объективной стороны преступления. В нем соотносятся элементы и признаки преступления, включающие возможность причинения реального вреда охраняемым законом общественным отношениям. Общественная опасность является объективным признаком данного преступления, и ее наличие или отсутствие не зависит от усмотрения правоохранительных органов законодательной власти.

The law defines a crime as a socially dangerous act or omission. It is based on a material symbol - the social threat of the act. Criminological social danger is the condition of the objective aspect of the crime. It relates the elements and symptoms of the crime, which includes the possibility of actual harm to the social relations protected by the law. Public danger is an objective symptom of this crime, and its presence or absence does not depend on the discretion of the law enforcement agencies of the legislature. The public danger of the disease is determined based on the following conditions:
1) the need for legal protection of public relations;
2) the extent, nature and gravity of the damage;
3) specificity of socially dangerous action (inaction);
4) in certain cases with the specificity of the subject of the crime.
The nature of the public threat is the unique manifestation of the harm of crime. It depends on the content
of the endangered object, the content of the damage to a specific social relationship (material, physical, moral, organizational, administrative, etc.). It also depends on the nature of the threat (violent and non-violent), the nature of the offense (intentional or negligent), and the content of the purpose and motive of the crime (violence, revenge, etc.). A socially dangerous action (inaction) is an expression of the relative danger of an action (inaction) of the same nature. It is determined by the state of commission of the crime, depending on the extent of the damage caused, the nature of the crime, the purpose of the crime, the stability of the evidence, the place and time of the crime.
The nature of the crime indicates that the socially dangerous action (inaction) is contrary to the criminal code, i.e. prohibited by the criminal law. Disobedience is defined as the prohibition of an offense under criminal law, with the threat of punishment to the offender. Public danger includes the objective nature of the crime. The symptoms of public danger and illegality are continuous in the concept of crime, they are the basis of the materialization of the crime and they are closely related to each other.
A person who has committed a crime, if his guilt is known and the norms of criminal law are violated based on his actions, he is charged with a crime if the signs of the crime appear. In criminal law, the occurrence of all the elements of a crime is called the elements of the crime. The only basis for criminal liability is the composition of the crime. The law provides for two bases of criminal liability.
1. The emergence of a real social danger (an image of human behavior).
2. The legal (law) basis is the presence of the elements of the crime when it endangers the society. Crime - an act (act or omission) that harms or threatens to harm objects protected by criminal law is
considered a socially dangerous sin. Only an act or omission that is inherently dangerous to society can be a crime. A socially harmful act or omission represents a risk of harm to legally protected interests. Criminal law defines a crime as an act or omission that endangers society. It is based on its materiality, its social threat. Public endangerment is a crime against specific social norms. It links the illegal elements and elements of a crime that includes its potential to cause real harm to social relations protected by law. References:
