Criminal liability is one of the most common forms of legal liability, along with administrative, civil, and regulatory liability. Accordingly, in order to determine the type of responsibility that a person who has committed a criminal act should be subjected to, it is necessary to find out which law he violated. The level of danger of crime is higher for the society than the crime. The criminal law of our country is based on the Penal Code and it is the sacred duty of every person to obey the law. Уголовная ответственность является одной из наиболее распространенных форм юридической ответственности наряду с административной, гражданской и нормативной ответственностью. Соответственно, чтобы определить вид ответственности, которой должно быть подвергнуто лицо, совершившее преступное деяние, необходимо выяснить, какой закон он нарушил. Уровень опасности преступности для общества выше самой преступности. Уголовное право нашей страны основано на Уголовном кодексе, и соблюдение закона является священной обязанностью каждого человека. Criminal law defines as the basis of criminal liability the commission of acts or omissions dangerous to the individual, society or the state. Criminal law measures are prescribed based on the criminal acts provided for in the Criminal Code of Turkmenistan.

A criminal charge, as a legal consequence of the crime committed, remains in effect only for a limited period of time. That is, it has a start and end time. Establishes criminal responsibility based on legal circumstances, such as the consideration of a criminal case and the imposition of a penalty. Criminal liability is completed in court. Criminal responsibility testifies to the full realization of the obligations and rights of the subjects of criminal legal relations. The implementation of the rights and obligations of the subjects of criminal law relations is determined by the criminal law relations that arise between those subjects. The application of criminal law is the final part of the implementation of criminal responsibility. The order of bringing to criminal responsibility is determined by the individual decisions of the agencies applying the criminal law. Evidence of a criminal conviction can vary. It includes: recognizing and indicting a person as guilty of violating the law, imposing punishment on a person by a court's conviction, applying sanctions in accordance with criminal law, or acquitting a person of criminal responsibility and punishment. Criminal law documents are divided into the following types:

1) documents using punishment;

2) certificates of immunity from criminal liability and punishment.

The first type refers only to guilty verdicts, because the imposition of punishment for the commission of a crime can only be used by a court sentence. The second type includes various documents based on the criminal law, which exempts the individual from criminal liability or punishment. Two types of implementation of criminal responsibility are distinguished:

1) conscientious compliance with criminal laws;

2) enforce the requirements of the criminal law (under the threat of sanctions).

There are three types of implementation of criminal responsibility in the form of state coercion:

a) taking action without assigning punishment to the guilty;

b) assigning a punishment to the offender and failing to comply with that measure in reality;

c) appointing a punishment to the guilty party and carrying out the punishment in reality. References

The level of danger of crime is higher for the society than the crime.

The criminal law of our country is based on the Penal Code and it is the sacred duty of every person to obey the law. The Criminal Code is of great importance in maintaining public order and public order. In case of non-restraint from the offenses specified in the Criminal Code and in the event that such violations are dangerous to the society, the violations are considered crimes and the punishment for their commission is prescribed based on the judgment issued by the court. Differentiation of crimes from other violations depends on the level of social danger and several objective and subjective circumstances. In most cases, the difference between a crime and other legal violations is determined by the object of the offense. As a general rule, the objects of criminal torts are more important and valuable than the objects of other torts. However, the more common objective condition that distinguishes the offenses set forth in the Criminal Code from other violations is that it involves the occurrence of major, substantial, and significant harm. The characteristics of each type of criminal responsibility are determined by the material characteristics and symptoms of the offense, depending on which the nature and procedure of applying the punishment appears. Criminal punishment can only be imposed on the

basis of a court order.

Crime differs from other offenses in that it is contrary to criminal law. Crime is always against the criminal law and endangers the objects protected by the criminal law. A felony differs from other violations in its legal consequences. A criminal conviction only arises on the basis of a conviction and imposes various limitations. Disciplinary responsibility is applied to the violation of duties and rights in the service, work, which is not prosecuted in the criminal procedure. Civil liability arises from the violation of obligations and rights arising from civil transactions. Administrative responsibility is brought to the guilty persons who have done what they have done. Competent authorities (officials) use management measures, and in some cases, management-remedial measures against those who manage them.

Another characteristic of criminal liability is that it is the only law that governs the matter. For example, while criminal responsibility is regulated only by the Criminal Code, administrative responsibility is regulated by various norms, for example, through Laws, Decrees, Decisions. Another aspect of criminal responsibility that differs from administrative responsibility is that the first commission of a certain act leads to the emergence of administrative responsibility, while the repetition of such acts, the commission of two or more of them, can lead to the emergence of criminal responsibility. But here, the main feature appears, that is, the culprit must have been officially administratively responsible for the committed act, and it is mandatory to have a relevant document. If a person has committed an administrative offense two or more times and was not previously held administratively liable for it, then criminal liability does not arise. References:

Аннотация

Несомненно, статья о деятельности военной полиции Вооруженных Сил РФ (ВП ВС РФ), в условиях наличия прямых угроз (военной, внешние экономические санкции, экстремизм, теракты, коррупция) и проведения специальной военной операции (далее - СВО), контртеррористических операций (КТО) весьма уместны и актуальны. Деятельность военной полиции должна соответствовать указам Президента РФ и приказам Министра обороны РФ. Притом, она (ВП ВС РФ) может выступать как основной субъект в регулировании, обеспечении, безопасности и правопорядка - обеспечении жизнедеятельности на местах
